Welcome to the websites, portals, and online services of Hercor College Inc. (“Hercor,” “we,” “us,” “our”). These Terms & Conditions (“Terms”) govern your use of our websites, sub-domains, forms, portals (including Students’ Channel and Parents’ Channel), newsletters, and any other online services that link to these Terms (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy (available at /privacy-policy). If you do not agree, please do not use the Services.

2) Eligibility & School Policies

You must use the Services in compliance with applicable Philippine laws and with official school policies (e.g., Student Handbook, Code of Conduct, IT/Network Use Policy). Some portals are restricted to authorized users (e.g., enrolled students, parents/guardians, faculty/staff). By using restricted areas, you represent that you are duly authorized to do so.

3) Accounts, Security & Communications

  • You may need an account to access certain features. Keep your username and password confidential and do not share them. You are responsible for activities under your account.

  • Notify us immediately of any unauthorized access or suspected breach at [email protected].

  • By providing contact details, you consent to receiving transactional messages (e.g., enrollment notices, deadlines). You may opt out of optional marketing at any time.

4) Accuracy of Information

You agree to provide accurate, current, and complete information in forms and submissions. We may reject or remove submissions that are false, misleading, unlawful, or inconsistent with school policies.

5) Admissions, Programs & Disclaimers

  • Information on programs, requirements, schedules, tuition/fees, scholarships, and policies is provided for general guidance and may change without prior notice.

  • Website content does not constitute a binding offer or contract of admission, scholarship, or employment. Official decisions are communicated through designated offices and documents.

6) Online Transactions

If the Services allow payments (e.g., tuition/fees, event registrations or donations):

  • You agree to use valid payment methods and authorize the transaction amount, fees, and applicable charges.

  • All fees are quoted in Philippine Peso unless stated otherwise. Official receipts are issued by the Finance Office.

  • Refunds, cancellations, and adjustments follow school policies and applicable law; see the Finance Office or the specific event page for details.

7) User Content & Acceptable Use

“User Content” includes any data, files, messages, forms, comments, images, or materials you upload or submit.

You agree not to:

  1. Violate laws, intellectual-property rights, privacy/publicity rights, or school policies;

  2. Upload harmful code, spam, deceptive or defamatory content, pornography, hate speech, or threats;

  3. Harass, bully, or endanger others, or misuse campus systems;

  4. Attempt to gain unauthorized access to accounts, networks, or non-public Services;

  5. Impersonate another person or misrepresent your affiliation.

License you grant us. By submitting User Content, you grant Hercor College Inc. a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute such content for the purpose of operating and improving the Services and fulfilling school functions (e.g., processing applications, publishing event photos per consent, etc.). You represent that you have the rights to grant this license.

We may remove or disable access to User Content that we believe violates these Terms or the law.

8) Intellectual Property

All website content, text, graphics, logos, photos, videos, icons, and software are owned by or licensed to Hercor College Inc. and are protected by copyright, trademark, and other laws. 9) Photos, Audio & Video

School events may be documented for educational, archival, and promotional purposes consistent with the Privacy Policy. If you prefer not to be featured in public materials, contact the organizing office or the Data Protection Officer. Reasonable efforts will be made to accommodate requests consistent with law and logistics.

10) Third-Party Services & Links

The Services may link to third-party websites or use third-party tools (e.g., payment gateways, analytics, embedded media). We are not responsible for those sites or services. Review their terms and privacy practices.

11) Privacy & Cookies

Our Privacy Policy explains how we collect, use, share, and protect personal data and how to exercise data-subject rights under the Data Privacy Act of 2012. By using the Services, you consent to processing as described in the Privacy Policy.

12) Availability & Modifications

We aim to keep the Services available, secure, and up to date, but we do not guarantee continuous, uninterrupted, or error-free operation. We may modify, suspend, or discontinue any part of the Services at any time. Content is provided “as is” and may be updated without notice.

13) Disclaimers

To the fullest extent permitted by law, the Services and all content are provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of accuracy, fitness for a particular purpose, non-infringement, or availability. Where warranties cannot be disclaimed by law, they are limited to the shortest period permitted.

14) Limitation of Liability

To the fullest extent permitted by law, Hercor College Inc., its officers, employees, and agents shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, data, or goodwill, arising from or related to your use of (or inability to use) the Services, even if advised of the possibility of such damages. Our total liability for any claim shall not exceed ₱5,000 or the amount you paid to us for the service in question in the three (3) months preceding the claim—whichever is higher. Some jurisdictions do not allow certain limitations; these limits apply to the maximum extent allowed by law.

15) Indemnification

You agree to defend, indemnify, and hold harmless Hercor and its officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorney’s fees) arising from your: (a) use of the Services; (b) User Content; (c) breach of these Terms; or (d) violation of any law or third-party right.

16) Governing Law & Venue

These Terms are governed by the laws of the Republic of the Philippines. Any dispute arising from or relating to the Services shall be brought exclusively in the proper courts of Roxas City, Capiz, to the exclusion of all other venues, without prejudice to required administrative/regulatory proceedings.

17) Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date shows the latest version. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
